GENERAL TERMS AND CONDITIONS OF PURCHASE
These General Terms and Conditions of Purchase govern the use of the Lolacasademunt.com website (hereinafter "The Website") Lola Casademunt, S.L., constituted by deed granted before Notary Javier Franch Valverde, with Protocol 1800/2017, on 19 November 2017 with registered office in Madrid, Calle de Goya, 48, 28001 Madrid, holder of Tax ID No. B58527680, registered in the Companies Register of Barcelona in volume 9443, book 377, folio 77, section 3, page number 7179, 1st entry. The use by the customer of the services of the online shop presupposes, in any case, adherence to the General Terms and Conditions of Purchase in the version posted at the time of the purchase order. It is therefore advisable for customers to read these General Terms and Conditions before proceeding to make a purchase. Prior to contracting and during the purchase process, the Customer may access, file and print these general terms and conditions for consultation.
1. SCOPE OF THE CONTRACT.
These General Terms and Conditions of Purchase apply to the sale of all LOLA CASADEMUNT products on its website in Spain. LOLA CASADEMUNT informs that its website is exclusively aimed at an audience over 18 years of age. LOLA CASADEMUNT reserves the right to cancel a customer's access account if fraudulent, speculative or bad faith acts are detected in the use of this service.
2. PURCHASE LIMIT.
For security reasons, purchases of more than €1500 cannot be made. Customers interested in making larger purchases should email Customer Service at: email@example.com or call +34 675 29 74 68, where they will be provided with information on how to make the desired purchase.
The applicable prices are those indicated on the website on the date of the order. Prices are listed on each item and include taxes, as applicable. Once the purchase order has been completed, and before payment is processed, a final summary will be provided identifying the product(s) purchased and their total price (including shipping costs and taxes). The shipping costs are specified in the purchase guide available on the website.
Payment will be made at the end of the purchase process and will be an essential condition for the processing of the purchase. Under no circumstances may payment be made at a later date. Payment by deferred payment procedures such as cash on delivery, or payment in the shop at the time of collection of the order is not permitted. Accepted means of payment: Purchases can be paid by Visa®, Mastercard®, PayPal®, Sequra®, Bizum® and Bank Transfer. In any case, the choice of payment method is made during the purchase process on the corresponding screen.
LOLA CASADEMUNT uses secure payment systems from leading financial institutions in order to offer maximum security. Customers must notify LOLA CASADEMUNT of any undue or fraudulent charge on the card used for purchases, either by email or telephone, as soon as possible so that it can take the appropriate steps. Providers or issuers of means of payment may implement anti-fraud measures involving the rejection of certain types of transactions. LOLA CASADEMUNT is not liable for the application of such security policies.
You expressly authorise us to issue the ticket in electronic format, although you may state your wish to receive it in paper format at any time, in which case we will issue and send the ticket in this format.
Unless there are unforeseen or extraordinary circumstances, the delivery time will be as specified on the website depending on the shipping method selected, and at the latest within 30 calendar days from the purchase date. LOLA CASADEMUNT delivers throughout Spain, except in Ceuta, Melilla and the Canary Islands. Orders will be delivered to the address stated by the customer in compliance with the following characteristics:
5.1 Standard home delivery: Orders can be delivered to a private home, a place of work or any other address provided (with the exception of post office boxes, oil rigs, transport platforms or military bases). The billing address and the shipping address do not need to be the same.
5.2 Delivery incidents: In the event that the order cannot be delivered for any reason attributable to LOLA CASADEMUNT, you will be refunded all amounts paid, in the same form of payment used for the initial transaction.
6.1 Legal right to withdraw from the purchase.
a) Right to withdrawal.
You have the right to withdraw from this contract within 14 calendar days without providing any reason. The withdrawal period shall expire 14 calendar days from the day on which you or a third party stated by you acquired material possession of the products or of the last of the products (if delivered separately).
To exercise your right to withdrawal, you must notify us at LOLA CASADEMUNT, by calling +34 675 29 74 68 or emailing: firstname.lastname@example.org of the right to withdraw from the contract by means of an unequivocal statement (e.g. a letter sent by post or e-mail). You may use the withdrawal form which can be downloaded here, although its use is not compulsory.
b) Consequences of withdrawal.
In the event of withdrawal by you, we will refund to you all payments received from you, including the costs of delivery to the initial delivery address (with the exception of the additional costs resulting from your choice of delivery method other than the least expensive standard delivery method offered by us) without undue delay and in any event not later than 14 calendar days from the date on which we are informed of your decision to withdraw from this contract. We will proceed with the refund using the same payment method you used for the initial transaction. You will not incur any costs as a result of the reimbursement. Notwithstanding the foregoing, we may withhold reimbursement until we have received the goods, or until you have provided proof of return of the goods, whichever condition is met first.
6.2 Contractual right to withdrawal.
In addition to the legally recognised right to withdrawal mentioned above, we grant you a period of 20 days from the delivery of the products to return them (except for those mentioned in clause 6.3 below, for which the right to withdrawal is excluded). If you return the goods within the contractual period of the right of withdrawal, but after the statutory period has expired, you will only be reimbursed the price paid by you for the goods. You will be liable for the direct costs of returning the product if you do not return it using a courier organised by us. You may exercise your right of withdrawal in compliance with the provisions of Clause 6.1 above, but if you communicate your intention to withdraw from the contract after the legal withdrawal period has elapsed, you must in any case deliver the products to us within 20 days from the Shipment Confirmation.
6.3 Common provisions.
You can return all items (except masks and party wear) that have not been used, in perfect condition, with their corresponding ticket/invoice and original packaging. We will reimburse you the amount of the item in the same way in which it was paid within 14 working days after arrival of the product at our head office.
For returns of swimwear, they will arrive in your order with a security seal or sticker, so that you can try them on without the fabric coming into direct contact with your skin. If returned, the seal must not be removed, nor may it be returned in poor condition.
We recommend returning the products in the same packaging you received them, following the instructions you will find in the PURCHASE GUIDE, section: How do I make a return?
When we receive your request, we will automatically send a courier to pick up your order at the same address used to send the package to you, unless you give us another address in the message. We recommend wrapping the garment to be returned in its original packaging and including the invoice is required.
Once the product has been received by our warehouse and the relevant product review has been carried out, we will proceed to pay the amount for the product using the same method as payment for the order was made within a maximum period of 14 working days from the day the product arrives at our head office.
The collection service costs €5 per order and this amount will be deducted from the amount to be refunded, except in the case of a defective product or if there has been a delivery error.
In the event that you do not wish to return the products through us, you will be liable for the return costs. Please note that if you choose to return the goods to us carriage forward we will be entitled to charge you for any costs we may incur.
Please note that, once the order has been delivered, in the event of exercising the legal or contractual right of withdrawal, when you are the one who arranges the transport of the order, without this service having been offered by us, we cannot accept the risk on the return package when it is related to causes that are not attributable to LOLA CASADEMUNT. Moreover, remember that you will be responsible for the contents of the return package when using any of the return options offered by LOLA CASADEMUNT. In the event that there is an error in the contents of the return package that is not attributable to LOLA CASADEMUNT, we will be authorised to charge you the corresponding costs if it is possible to manage the return of the package to your attention.
6.4 Return of defective products.
In cases where you consider that the product does not conform to the stipulations of the contract at the time of delivery, you should contact us immediately through our contact channels providing the details of the product, as well as the damage it suffers, or by calling or sending a WhatsApp message to +34 675 29 74 68, where we will tell you how to proceed. You can return the product by handing it over to a courier that we will send to your home address when you request collection. We will carefully examine the returned product and will email you within a reasonable period of time regarding whether a refund or a replacement (if applicable) is appropriate. The refund or replacement of the item will be made as soon as possible and in any case within 14 days from the date on which we send you an e-mail confirming that the refund or replacement of the non-conforming item is appropriate. Amounts paid for products that are returned to us because of a defect, where such a defect actually exists, will be refunded to you in full, including the delivery charges incurred in delivering the product to you and the costs incurred by you in returning the product to us. The refund will be made using the same payment method used to pay for the purchase. In any case, the rights granted by the legislation in force shall remain unaffected.
7. AVAILABILITY OF PRODUCTS.
In the event of supply problems or if there are no products in stock, customers will be informed immediately and the amount of the out of stock product(s) will be refunded. LOLA CASADEMUNT will reimburse the relevant amount without undue delay and, in any case, within 14 calendar days. The refund will be made by the same means of payment used for the purchase.
8. GUARANTEE OF THE PRODUCTS PURCHASED.
The guarantee offered is that established in Spanish Royal Legislative Decree 1/2007, of 16 November, which approves the revised text of the General Act for the Defence of Consumers and Users.
9. SPECIAL CONDITIONS APPLICABLE TO TELEPHONE PURCHASES.
LOLA CASADEMUNT offers customers a telephone sales service by means of the telephone number +34 675 29 74 68, provided by LOLA CASADEMUNT on the website.
In order to make a telephone purchase, customers must (i) contact LOLA CASADEMUNT using the telephone numbers provided, (ii) inform LOLA CASADEMUNT of the products they wish to purchase, and (iii) provide a number of personal details. If customers refuse to provide personal data or if they are incorrect, LOLA CASADEMUNT will not be able to process the order.
Before placing the order, Customers must have followed the following steps:
1. Read and understand the General Terms and Conditions of Purchase available on the website.
2. Read and understand the essential characteristics of the products, which are available in the product information sections.
Once the telephone Purchase Order is completed, LOLA CASADEMUNT will email the customer at the address provided a link to the payment gateway by means of which the customer must proceed, after reading and accepting the General Terms and Conditions of Purchase, the payment of the corresponding goods, by clicking on the button "Pay", thus proceeding to the confirmation of Purchase Order.
After payment, LOLA CASADEMUNT will email the Customer the confirmation of the order.

The LOLA CASADEMUNT Customer Service Department will attend and respond to your complaint as soon as possible, and in any case within a maximum of one month. In the event that your request is not satisfactorily resolved, you may turn to the ordinary courts or file your complaint through the website http://ec.europa.eu/odrwhich will provide a single point of access for out-of-court settlement free of charge.
11. MODIFICATION OF THE GENERAL TERMS AND CONDITIONS OF PURCHASE.
LOLA CASADEMUNT reserves the right to modify these General Terms and Conditions of Purchase at any time. Any changes will not affect orders that are already in progress.
12. FORCE MAJEURE.
The performance by LOLA CASADEMUNT of all or part of its obligations shall be suspended in the event of an act of God or force majeure preventing or delaying performance. The following shall be considered as such, without this list being exhaustive: war, riots, insurrection, social unrest, strikes of any kind and supply problems not attributable to LOLA CASADEMUNT. LOLA CASADEMUNT will inform the customer of any such fortuitous event or force majeure within seven days of its occurrence. In the event that this suspension lasts longer than fifteen days, the customer will then have the possibility of cancelling the order in progress and will then be reimbursed in compliance with the conditions set out in point 6 of these General Terms and Conditions of Purchase.

At the time of purchase, the first payment is made by card, and the rest is automated depending on the monthly payments you have chosen. You can change the payment plan or pay in full at any time without additional costs. And you can also choose or change the day of the month you want to pay. SeQura will inform you at any time via email and SMS. It is a SeQura service, which provides the option to save your card details so you don't have to re-enter your payment details for your purchases.
